Eddy County Sheriff's Update for September

An habitual offender was recently sentenced for driving under revocation. This is Russell C. Cavanaugh of Bismarck’s seventh such offense in the past five years. He has been convicted twice in Ramsey County and four times in the City of Bismarck.

Cavanugh had his first brush with local authorities on July 29, when he was arrested on U.S. Hwy. 281 for speeding at a rate more than 30 miles over the posted speed limit. He was also cited for careless driving. In court, Cavanugh received a 60 day suspended jail sentence and 360 days of unsupervised probation. He was also ordered to pay $525 in fines and fees.

Jacob Solem of Duluth, Minn. (formerly of New Rockford) was arrested on July 30. A warrant had been issued for his arrest more than three years prior. He was charged with Class C Felony burglary for entering a Sheyenne home in 2015. The incident occurred between July 30 and Aug. 5, 2015, according to the complaint. He pleaded guilty to the charge on Nov. 12, 2015 and was sentenced to three years in jail, all suspended for two years of supervised probation. After violating the terms of his probation in April 2016, a warrant was issued for his arrest.

Solem served 44 days in jail at the Stutsman County Correctional Center, from his arrest until his revocation hearing on Sept. 12. In court he was sentenced to 44 days in jail (with credit for time served) and 360 days of unsupervised probation. He also has $1,060 in fines and fees to pay.

Casey Greywind of Fargo (formerly Oberon) was charged with possession of marijuana on Jan. 26. He was a passenger in a vehicle stopped for speeding. A warrant was issued for his arrest on Sept. 12 after he failed to appear in court for a status conference in the case. Greywind then filed a written guilty plea and waiver of appearance on Sept. 23, and Judge Hovey ordered him a $250 fine.

A warrant has been issued for Dawson Dubois of Ft. Totten. He was sentenced for driving under suspension and possession of drug paraphernalia on May 9. An order to show cause was filed against him on July 26 for failure to pay fines and fees as agreed, with the hearing date set for Sept. 12. After he failed to appear in court that day, a warrant was issued for his arrest.

Warrants have also been issued for the arrest of the following individuals who either failed to appear in court or have violated terms of a previous sentence: Preston Neumiller of Bismarck (formerly New Rockford) and Tyson Kane Holy Bull of Churchs Ferry (unlawful possession of drug paraphernalia- $50 cash appearance bond). Cameron Hurst of New Rockford had two run-ins with authorities recently. On July 7, he was cited for possession of marijuana, a Class B Misdemeanor. According to the complaint, he had 2 grams in his possession. He pleaded guilty to the charge on Sept. 12 and was ordered to pay $250 in fees. Then, on Aug. 27, he was charged with driving under suspension. He pleaded not guilty to that charge on Sept. 12 and is scheduled for a pre-trial conference on Nov. 14.

Dyllan Peltier of New Rockford is charged with driving under revocation, his fifth offense in five years. He was stopped while driving in New Rockford on Aug. 2. He pleaded not guilty to the charge on Sept. 12. He is due in court for a pre-trial conference Nov. 14. He was previously convicted of driving under revocation in Cass County in 2015, the City of Fargo in 2015, Eddy County in 2017 and Barnes County in 2018.

Antoine S. Lavallie IV of Oberon pleaded guilty to driving under the influence and was sentenced in court on Sept. 12. He was arrested on Aug. 10 near mile marker 139 on U.S. Hwy. 281. A test taken at the scene revealed a 0.163% blood alcohol content,, twice the legal limit. Judge Hovey sentenced him to two days in jail and ordered him to pay $1,000 in fines and fees. He is also subject to 360 days of unsupervised probation.

Marie B. Scott of Larimore (formerly of Fessenden) appeared in court for felony endangerment of a child or vulnerable adult and two misdemeanor charges of ingesting marijuana and ingesting a controlled substance other than marijuana. The charges were filed in June after Social Services contacted the Eddy County Sheriff’s Office asking for a welfare check at a residence in New Rockford. Authorities found drug paraphernalia in the apartment within the reach of the children that were present.

Scott pleaded guilty to felony endangerment of a child and ingesting a controlled substance other than marijuana. The marijuana charge was dismissed. She was sentenced to 360 days in jail, with 355 days suspended, and 360 days of unsupervised probation. She was also ordered to pay $560 in fines and fees, complete a chemical dependency evaluation and participate in the 24/7 sobriety program for four months.

Jesse D. Heck of Carrington was sentenced for possession of methamphetamine as a result of a traffic stop on Aug. 11. Heck was stopped on Hwy. 281 for failure to display current registration tabs, and a subsequent search of the vehicle yielded the discovery of 3.6 grams of meth. Heck was also cited for driving without insurance and not having a driver’s license in his possession. Heck pleaded guilty to the possession charge on Sept. 12, and his sentence was deferred. Hovey did, however, order him to complete a chemical dependency evaluation and pay $325 in court fees.

Kalen J. Azure of Dunseith is accused of driving under suspension and possessing drug paraphernalia after a traffic stop on Aug. 13. He was initially stopped for following too closely. He was also cited for failure to wear a seatbelt. Azure is due for an initial appearance in the case on Oct. 10. Azure’s passenger, Jalen B. Davis of Dunseith, was also cited for possession of drug paraphernalia. Davis pleaded guilty in court on Sept. 12 and paid a $100 court fee for the infraction.

Brenton K. Greiner of New Rockford was arrested Sept. 20 for driving under revocation. He currently has two open cases, one each for driving under suspension and driving under revocation. Both charges were filed within 30 days of each other, as the first offense occurred on Aug. 27. He pleaded not guilty to the first charge on Sept. 12 and is scheduled for a pre-trial conference on Oct. 10. He will also make his initial appearance on the second charge Oct. 10. 

Rebecca Parsons of Jamestown is accused of unlawful possession of drug paraphernalia, a Class C Felony. Authorities say she was stopped for speeding on Aug. 22 and a glass pipe was found in her possession. She was also cited for driving without liability insurance. Parsons’ preliminary hearing/arraignment on the felony charge is set for Oct. 10. 

Marlin A. Thompson of Saint Michael was sentenced on a 9-year-old charge for minor in consumption last month. Thompson was charged with criminal mischief and minor in consumption on June 12, 2010. He failed to appear in court on June 21, so a warrant was issued for his arrest. He moved out of state and the warrant remained open for more than nine years before he was arrested on Sept. 4. He pleaded guilty to the charges in court on Sept. 12, and he was given a 12 day suspended jail sentence and ordered to pay $250 in fees.

Karissa Richotte of Ft. Totten was stopped on May 21 and charged with driving under suspension and unlawful display of license plates. Judge Hovey dismissed the DUS charge on Aug. 9, just days after a warrant was issued for her arrest for failure to appear in court. She pleaded not guilty to the license plate charge and is due for a pre-trial conference in the case on Nov. 14.
