Eddy County Sheriff's update for February

Warrants have been issued for the following individuals, all who failed to appear in court on Feb. 14 or 21 as ordered: Lisa J. Chenze of Jamestown, Sasha Silvis of Northwood, Lathan T. Chaske and Sylvester P. Littlewind of Ft. Totten, Andrew L. Scevers and Joshua Brydon of New Rockford, Anthony E. Brown and Jobeth M. Eagle of Bismarck and Holly R. Larvie of Devils Lake. Four of the individuals named above were scheduled to appear on an order to show cause for not complying with the conditions of their sentences: Anthony Brown, Jobeth Eagle, Sylvester Littlewind and Holly Larvie. Brown was scheduled to appear on an order to show cause. Authorities say he failed to make payments as agreed on a Nov. 15, 2018 conviction for driving under suspension. Eagle was convicted of driving under suspension in court on Nov. 15, 2018, and she also failed to pay fines and fees as ordered. Littlewind reached a plea agreement in October 2018 for driving under the influence, possession of drug paraphernalia, making false reports to law enforcement and driving under suspension. He then failed to make payments as agreed, prompting the order. Larvie’s case dates back to 2017, when she reached a plea agreement for possession of a controlled substance, possession of drug paraphernalia and driving without a license.

Joshua Brydon was scheduled to change his plea on Feb. 21 for driving under suspension, possession of controlled substance, possession of drug paraphernalia, possession of a controlled substance schedule IV and possession of marijuana. When he failed to appear in court, a bench warrant was issued for his arrest.

The other three were scheduled to make initial appearances on charges. Lisa J. Chenze of Jamestown was cited on Dec. 16, 2018 for misdemeanor possession of a controlled substance, marijuana, and possession of drug paraphernalia. Sasha Silvis of Northwood was cited for driving under suspension and driving without liability insurance on Jan. 16. Lathan T. Chaske of Ft. Totten has been charged with driving under suspension, possession of drug paraphernalia - marijuana and possession of a controlled substance, marijuana. He was initially stopped for tinted windows on Feb. 6. Andrew L. Scevers is accused of writing a check without sufficient funds.

Jason E. Vetsch of Bismarck faces charges of driving under suspension and possession of drug paraphernalia after a Dec. 26 traffic stop. He failed to appear in court on Feb. 14 and was later arrested on a bench warrant. He was transported to Jamestown, where he was released on a PR bond. He is due to make his next court appearance for the Eddy County charges March 14.

Dakota L. Lafferty of Jamestown was cited for driving under suspension and possession of marijuana paraphernalia. He failed to appear in court on Feb. 14, so a bench warrant was issued for his arrest. He was later apprehended and pleaded guilty to the charges in court on Feb. 22. Judge Hovey handed down a 5 day suspended jail sentence, and ordered him to pay $375 in fines and fees. Lafferty is currently serving 360 days of unsupervised probation.

Debra M. Nienow of Kulm, N.D., pleaded guilty to possession of a controlled substance, marijuana and possession of drug paraphernalia in court on Feb. 14. Per the plea agreement, she was ordered to pay $400 in court fees, and her sentence was deferred until Aug. 13, 2019. Her record will be expunged pending successful completion of six months unsupervised probation.

Eddy County State’s Attorney Ashley Lies filed a petition to revoke the probation for Austin D. Perleberg-Hunt of Jamestown on Feb. 6. Hunt was given a 321-day suspended jail sentence on Nov. 15 after he pleaded guilty to theft from a motor vehicle/firearm. He stole a rifle out of a vehicle in New Rockford on July 22; the gun was recovered but was damaged. His probation was revoked on Feb. 14 after he admitted to failing to report to his parole officer, not filing a change of address and not paying fines and fees as ordered. He faces a host of open charges in Stutsman County, including Class B Felony possession of marijuana with intent to deliver; three Class C Felony charges of aggravated assault, breaking into a vehicle and theft of property; and four misdemeanor charges, two each for ingesting a controlled substance and possession of drug paraphernalia. He is due to appear for a preliminary hearing/arraignment on the Stutsman County charges April 3. He is currently held in the Stutsman County Correctional Center.

Amanda R. Dockter of Valley City, formerly of Kensal, also had her probation revoked. She was convicted of felony child neglect and solicitation of a minor on Nov. 9, 2017. The case dates back to 2016 when she had sexual contact with a 16-year-old male. According to the petition filed by her parole officer, Tyler Falk, she has violated various conditions of her probation by testing positive for methamphetamines and committing additional criminal acts including possession of drug paraphernalia, possessing a firearm and ingesting controlled substances. Dockter appeared in court on Feb. 14, where she was re-sentenced on the corruption and child neglect charges. She has now been committed to the Department of Corrections to serve a one year and one day prison sentence, with credit for 31 days served. Upon release from prison, Dockter will serve five years of supervised probation.

The drug case for Monica D. Thommes of McHenry is also closed. She entered amended pleas in court on Feb. 14 for Class C Felony possession of drug paraphernalia, two counts of misdemeanor possession of a controlled substance (one for each methamphetamines and marijuana), and misdemeanor possession of drug paraphernalia, marijuana. Judge Hovey sentenced her to serve three years in the Dakota Women’s Correctional Rehab Center in New England, with one year and 364 days suspended. Once released, Thommes will be subject to two years probation. She was also assessed $560 in fines and fees.

Timothy R. Clapper Sr. of New Rockford reached a plea agreement with authorities in his 2018 tool theft case. He entered an amended plea of guilty for one Class B Felony charge of theft of property, and as a result a second charge was dismissed. Judge Hovey handed down a suspended 360-day jail sentence and also suspended the $2,000 fine. Clapper is subject to one year of unsupervised probation and will pay $775 in court fees.

Richard W. Hucke Sr. of New Rockford pleaded guilty to Class B Felony possession of marijuana with intent to deliver and misdemeanor possession of drug paraphernalia. He also received a suspended sentence from Hovey, his for a period of one year. Hucke was assessed $1,050 in fines and fees and ordered to serve one year of unsupervised probation.
